Terms and Conditions

Allergy & Dietary Warnings

  • THE SUGAR TOP BAKERY products contain, and/or are made in a kitchen which also processes: wheat, eggs, dairy, soy, nuts, and peanuts. We are unable to serve those with severe food allergies at this time.
  • All allergens within a product will be outlined by THE SUGAR TOP BAKERY at the time of invoicing.
  • The Client is responsible for informing THE SUGAR TOP BAKERY of any allergies within 24 hours of receiving an Invoice or Order Confirmation. To contact THE SUGAR TOP BAKERY please email thesugartopbakery@gmail.com with your Invoice or Order Number and include any allergies.
  • The Client is responsible for indicating to guests’ potential allergy hazards, and THE SUGAR TOP BAKERY will communicate its ability to accommodate restrictions.

Changes to Order

  • Any changes must be submitted 3 days prior to delivery or pick-up. Any changes made afterwards may be incorporated at the discretion of THE SUGAR TOP BAKERY and may include an additional fee, or require deposit (or additional deposit).
  • There will be no changes allowed within 24 hours of delivery or pick-up.
  • Changes for large or customized orders (such as Cakes, Cookie Cakes, or orders with custom flavors, packaging, or any other customizations not offered on our Regular Menu or Seasonal Specials Menu) must be made within 24 hours of "Order Acceptance". It is the Client's responsibility to inform THE SUGAR TOP BAKERY of any desired changes. Failure to notify THE SUGAR TOP BAKERY will not result in a refund at the time of delivery/pick-up.

Order Cancellations (and Refunds)

  • Failure to receive delivery or pick up an order with Deposit will not result in a refund. (Changes to the delivery/pick-up date are considered a "Change to Order" and must follow the rules outlined in the "Changes to Order" section found above.
  • Failure to receive delivery for, or pick up, an order that is Paid In Full will not result in a complete refund. Partial refunds may be considered on a case by case basis. 
  • If there is a defect in your product please contact THE SUGAR TOP BAKERY via email (thesugartopbakery@gmail.com). A proportionate refund will be given if we determine there is a quality deficiency. THE SUGAR TOP BAKERY retains the right to judge our product quality for ourselves. A refund of any amount is not guaranteed. 
  • If you try one of our products and just don't care for it, we hope you try something different next time; however, a refund will not be given.
  • Cancellations for large or customized orders (such as Cakes, Cookie Cakes, or orders with custom flavors, packaging, or any other customizations not offered on our Regular Menu or Seasonal Specials Menu) must be made within 24 hours of "Order Acceptance". It is the Client's responsibility to inform THE SUGAR TOP BAKERY of any special circumstances that cause a cancellation of this order type, at which time, a refund of any deposit can be considered, but is not guaranteed.
  • No refund will ever be given for an amount in excess of the original purchase price regardless of circumstance.

Deposits and Payments (Large and Customized Orders)

  • The date of delivery or pick-up is considered “booked” upon receipt of a non-refundable deposit equaling 50% of the total value of the custom order.
  • The final payment is due 2 days prior to the delivery/pick-up date, unless otherwise communicated.
  • If the Client fails to make any required Deposit, or Installment, Payment(s), THE SUGAR TOP BAKERY will cease work, the order will be cancelled, and no refund of any amount will be given.

Liability

  • THE SUGAR TOP BAKERY is not responsible for bodily injury, property or any consequential damage which may result from products/services provided.
  • THE SUGAR TOP BAKERY is not responsible for any damage to the goods/services provided after delivery/pick-up of the product(s) has been completed.

Content

  • THE SUGAR TOP BAKERY reserves the right to use all photographs, videos, and any other content of the customers order for advertising purposes unless otherwise requested and agreed upon mutually at the time of the customer placing an order.

Communication

  • All communications with THE SUGAR TOP BAKERY are to be made through email, or our chat function found within your Order Confirmation link.
  • If you placed a custom order and received an Invoice, all communication should be made through email or by phone (when applicable).
  • No communication regarding ANY order will be handled through Facebook, Messenger, Instagram, or any other social media platform.
  • THE SUGAR TOP BAKERY will NEVER ask for payment via any Social Media platform, Venmo, Zelle, or any other processer except through official Invoices (powered by Square) or official Order Requests (powered by My Custom Bakes).

THE SUGAR TOP BAKERY reserves the right to modify its Terms and Conditions policy at any time without notice.
